With the high levels of business disputes stemming from market volatility, the ever increasing burden of litigation is of no exception. This not only takes a toll on the country’s justice system but ultimately sparked a growing realisation amongst business community on the importance of Alternative Dispute Resolution (ADR). Today not a single scope of activity can be named where negotiation, mediation or arbitration cannot be applied. ADR professionals provide help in every field – from child upbringing to implementation of the most complicated hi-tech projects, not only settling conflicts and differences, but also preventing them, thus saving financial and time resources, enhancing protection of investments, harmonization of business and social relations. It is critical to know the various methods and techniques that govern a successful negotiation, mediation or arbitration.

 

Certificate in Conflict Management (CCM)

(15 hours – 2 days)

The course will focus on the dynamics of power in negotiation - who has it, how did they get it, how is it used, and how it impacts settlements. It will explore specific techniques in maximizing each party’s potential to negotiate at their best. The course will cover the basic foundations for effective negotiation, understanding the bargaining style, setting goals in negotiation, nurturing relationships critical to negotiation success, maximizing leverage to conclude a deal and body language skills. The program will also explore underlying negotiation orientations and strategies and how they are confronted and employed by mediators. Through discussion, simulations, exercises and role-plays, it will focus on the structure and goals of the mediation process and the skills and techniques mediators use to aid parties in overcoming barriers to dispute resolution.

The program will also help participants integrate innovative techniques into their work by learning techniques for creating value in negotiation, learning how to use differences and disagreements to your advantage, understanding how to negotiate what you need without sacrificing the relationship, recognizing and responding constructively to difficult negotiation tactics, and understanding common cognitive and psychological mistakes in negotiation.

After successful completion, the candidate is eligible for empanelment as an IIAM Conflict Manager, subject to the norms of enlistment.

 

Certificate in Arbitration Law (CAL)
(Code – ITP12)
(15 hours – 2 days)

The course offers the participants to know the underlying theory of arbitration law and practice, with emphasis on drafting of arbitration clauses and agreements, awards, procedure of arbitration, important case laws, ethical issues, venue and institutional arbitration methods. The program will also look at the art of drafting of a dispute resolution clause appropriate to the parties’ business needs and dispute resolution desires. The program will provide a solid foundation in ADR processes and to serve as ADR practitioners and neutrals. After successful completion, the participant will be eligible for empanelment as an IIAM Arbitrator, subject to the norms of enlistment. For details; see
